These Terms and Conditions (“Terms”) govern your access to and use of our website located at https://swagly.store (the “Site”) and any related services (collectively, the “Services”). 3.1 Registration

To place an Order, you may be required to register for an account on the Site (“Account”). You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

3.2 Account Security

You are responsible for safeguarding your password and any other login credentials. You will not share your Account credentials with any third party and will notify Swagly immediately of any unauthorized use of your Account.

3.3 Account Termination

Swagly may terminate or suspend your Account at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or Swagly.

4. Orders and Purchase

4.1 Order Acceptance

All Orders are subject to acceptance and availability. Swagly reserves the right to refuse or cancel any Order for any reason, including but not limited to:

  • Product or service availability;
  • Errors in pricing or product information;
  • Suspicious payment activity;
  • Violation of these Terms.

4.2 Pricing

Prices are displayed on the Site in Ghc and are subject to change without notice. Taxes, duties, and shipping fees may apply and will be calculated at checkout.

4.3 Payment

We accept payment via major credit cards, debit cards, and other payment methods listed on the Site. By providing payment information, you represent and warrant that you are authorized to use the payment method.

5. Shipping and Delivery

5.1 Shipping Methods

We offer standard and expedited shipping options. Estimated delivery times depend on your location and selected shipping method.

5.2 Risk of Loss

Risk of loss and title for Products purchased pass to you upon our delivery to the carrier.

6. Returns, Exchanges, and Refunds

6.1 Return Eligibility

To be eligible for a return or exchange, Products must be:

  • Unworn, unwashed, and undamaged
  • In original packaging with all tags attached
  • Returned within 15 days of the delivery date

6.2 Return Process

  1. Initiate a return by contacting our Customer Support at hello@swagly.store within 30 days.
  2. Ship the Product back using a trackable carrier.
  3. Once received and inspected, we will notify you of the approval or rejection of your refund.

6.3 Refunds

Approved refunds will be processed to the original payment method within 7–10 business days. Shipping fees are non-refundable.

7. Prohibited Conduct

When using the Site or Services, you agree not to:

  1. Violate any applicable law or regulation.
  2. Infringe upon intellectual property rights.
  3. Transmit harmful code (e.g., viruses).
  4. Harass, abuse, or harm others.

You represent and warrant that you own or otherwise have the right to post your User Content.

  • THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
  • SWAGLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAGLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SWAGLY’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless Swagly, its officers, directors, employees, and agents from any claims, liabilities, losses, damages, costs, or expenses arising from:

  1. Your breach of these Terms;
  2. Your violation of any applicable law or regulation;
  3. Your User Content or use of the Site or Services.

12. Termination

Swagly may terminate or suspend your access to the Site or Services at any time, with or without cause and without notice. Sections 6 (Returns), 8 (Intellectual Property), 10 (Disclaimers), 11 (Indemnification), and 14 (Governing Law) survive any termination.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ghana, without regard to conflict of laws principles. Any dispute arising under or relating to these Terms will be resolved through binding arbitration in Ghana under the rules of the Ghana Arbitration Centre (GAC).

14. Changes to Terms

We may modify these Terms at any time by posting revised Terms on the Site. Your continued use of the Site following such changes constitutes your acceptance of the modified Terms. We recommend that you review these Terms periodically.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck, and the remaining provisions will remain in full force and effect.

16. Waiver

No waiver of any term or condition will be deemed a further or continuing waiver of such term or condition or any other term or condition.
